RESOLUTION NO. 2002–54

 

RESOLUTION TO PROVIDE SERVICE ON

 FOREST SERVICE 90 ROAD

 

 

 

WHEREAS, the Board of County Commissioners have determined that it is in the County’s best interest to provide, to the extent practicable, county residents, commercial operators, members of the public, recreationalists, law enforcement, search and rescue and emergency personnel, and others year long access to the northwest section of the County via the United States Forest Service 90 Road (“Forest Service Road”) between Mile Post 0.00 to 19.7;

 

WHEREAS, the County and the U.S. Forest Service have annually entered into a Forest Road Agreement where both agencies have agreed to cooperate to maintain roads of mutual use;

 

WHEREAS, the County Commissioners have determined that this portion of the Forest Service Road is of mutual benefit and use to the Forest Service and Skamania County;

 

WHEREAS, the County has the authority under RCW 36.82.140 and 36.33.220, and under the Forest Road Agreement to use Road Funds (RCW Chapter 36.82) to maintain (e.g. snowplow) this portion of the Forest Service Road;

 

WHEREFORE, the Board hereby authorizes the County Engineer to cooperate with the Forest Service to assist the Forest Service to maintain the above described Forest Service Road to provide, within reason, year around use;

 

WHEREFORE, the County Engineer is further authorized, if necessary, to negotiate with the Forest Service to include this portion of the Forest Service Road within Schedule “A” of the Forest Road Agreement;

 

WHEREFORE, the County Engineer may use RCW Chapter 36.82 Road Funds, or any other funds appropriated for such use, to maintain this portion of the Forest Service Road, in cooperation with the Forest Service, to provide access comparable to other mountainous and remote roads subject to inclement weather.

 

WHEREAS, the County Commissioners do not intend for this portion of the Forest Road to become  a County road or for it to be maintained in a manner that is consistent with the County’s main arterials.
