ORDINANCE 2003-03
(AMENDING ORDINANCE 2002-06 AND ORDINANCE 2002-18)
AN ORDINANCE TO EXTEND ORDINANCE 2002-06 AND 2002-18’S MORATORIUM ON REZONE APPLICATIONS FOR ANY PARCEL LOCATED WITHIN TOWNSHIP 1 NORTH, RANGE 5 EAST; TOWNSHIP 2 NORTH, RANGE 5 EAST; TOWNSHIP 3 NORTH, RANGE 5 EAST; TOWNSHIP 1 NORTH, RANGE 6 EAST; TOWNSHIP 2 NORTH, RANGE 6 EAST; OR TOWNSHIP 3 NORTH, RANGE 6 EAST, WILLAMETTE MERIDIAN, LYING NORTHERLY OF THE COLUMBIA RIVER GORGE NATIONAL SCENIC AREA BOUNDARY AND SOUTHERLY OF THE GIFFORD PINCHOT NATIONAL FOREST BOUNDARY, GENERALLY KNOWN AS THE “WEST END” OF SKAMANIA COUNTY.
WHEREAS, the Board of County Commissioners on May 6, 2002, adopted a six-month moratorium on all rezone applications for any parcel located within Township 1 North, Range 5 East; Township 2 North, Range 5 East; Township 3 North, Range 5 East; Township 1 North, Range 6 East; Township 2 North, Range 6 East; Township 3 North, Range 6 east, Willamette Meridian, lying northerly of the Columbia River Gorge National Scenic Area Boundary and southerly of the Gifford Pinchot National Forest Boundary, commonly known as the “west end” of the County, until the Comprehensive Plan and Zoning Amendments were completed; and,
Whereas, the Board of County Commissioners on October 7, 2002, adopted an ordinance to extend the moratorium on all rezone applications in the above named areas for an additional six-month period of time; and,
WHEREAS, the Planning Department has held seven meetings with the West End Community Members; and,
WHEREAS, the Planning Department has developed a Work Plan and Timeline for the County Comprehensive Plan and West End Zoning Update, and will continue to meet with the West End Community Members to update the Comprehensive Plan, zoning ordinances and Zoning Maps; and,
WHEREAS, the Planning Commission has recommended, and concerned citizens have requested, the Board to extend the moratorium; and
WHEREAS, the Board of County Commissioners conducted a public hearing to consider extending Ordinance No. 2002-06 and No. 2002-18’s moratorium; and,
WHEREAS, the Board of County Commissioners has the authority pursuant to RCW 36.70.795 to extend the moratorium for one or more six-month period(s) if a subsequent public hearing is held and finding of fact are made prior to each renewal; and
WHEREAS, the Board of County Commissioners finds a sufficient basis to extend the moratorium for an additional 6 months to maintain the status quo of the West End pending the County’s consideration of updates to the Comprehensive Plan and maps and to the zoning text and maps; and,
WHEREAS, The Board of County Commissioners intends for these recitals to constitute its “findings of facts” as required by RCW 36.70.795.
NOW, THEREFORE BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS: the Board of County Commissioners hereby amends Ordinance No. 2002-6 and No. 2002-18 to extend the moratorium on the acceptance of rezone applications for any parcel located within Township 1 North, Range 5 East; Township 2 North, Range 5 East; Township 3 North, Range 5 East; Township 1 North, Range 6 East; Township 2 North, Range 6 East; Township 3 North, Range 6 east, Willamette Meridian, lying northerly of the Columbia River Gorge National Scenic Area Boundary and southerly of the Gifford Pinchot National Forest Boundary, for an additional six-month period, six months from the date of adoption of this ordinance.
BE IT FURTHER ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS that the ordinance, and its recitals, shall constitute the Board of County Commissioner’s findings of facts per RCW 36.70.795.
